I agree that I am an adult (over the age of 18) and that I am responsible for anyone accompanying me, regardless of age. I am fully aware of the risks and hazards associated with my participation in this activity, including the risk of physical injury or disability as the result of such injury, or death and I, and any and all peoples accompanying me, are voluntarily participating in this event.
In return for being allowed to participate in Community Beautification and Improvement Projects DBA Keep Soddy-Daisy Beautiful activities and all related activities, including any activities incidental to such participation (“Participant Activities”), the undersigned Participant (or Parent/Legal Guardian of Participant if Participant is under age 18 (hereafter referred to using “I”, “me”, or “my”) releases and agrees not to sue Community Beautification and Improvement Projects DBA Keep Soddy-Daisy Beautiful or its officers, directors, employees, sub-contractors, sponsors, (“the Foundation”) and the City of Soddy-Daisy, Tennessee (“City”) from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property damage, personal injury, or wrongful death arising as a result of my participation in the Volunteer Activities wherever, whenever, or however the same may occur. And, hereby grants to Community Beautification and Improvement Projects DBA Keep Soddy-Daisy Beautiful or its officers, directors, employees, sub-contractors, sponsors, (“the Foundation”) and the City of Soddy-Daisy, Tennessee (“City”), The Photographic Society of Chattanooga, and each of its subsidiaries, affiliates, agents, advertising or promotional agencies, and partners, and all such entities’ officers, directors, agents, employees, respective successors and assigns (collectively, “Authorized Parties”), the absolute and irrevocable right and permission to use, publish, broadcast and/or copyright the use of Participant’s name, address, voice, photograph and/or likeness, caricature, and personal information, in its current form or as retouched, digitized, cropped, altered, distorted or modified in any way, in any and all advertising, promotional, or other materials based upon or derived from the Participant Activities in any manner, in any media whatsoever for any and all purposes, including by way of example but without limitation advertising, promoting or publicizing products and services throughout the universe, in perpetuity, in any and all media now known or hereafter devised (including without limitation on the Internet), without additional compensation. I further agree that anything derived therefrom will be owned solely by the Authorized Parties. I shall not authorize the use of any print, negative or other copy thereof by anyone other than the Authorized Parties.
I understand that this document is intended to be as broad and inclusive as permitted by the laws of the State of Tennessee and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.
In return for receiving permission to participate in the 2022 Soddy-Daisy Fall Festival & Great Pumpkin Chase Event, the Participant hereby releases, waives, discharges and covenants not to sue Keep Soddy-Daisy Beautiful, The City of Soddy-Daisy, The Photographic Society of Chattanooga, its agents, volunteers, or officers from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant , or any of the property belonging to the Participant whether caused by the negligence of the Participant/Releaser, or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted.
I am fully aware of the risks involved and hazards connected with the 2022 Soddy-Daisy Fall Festival and Great Pumpkin Chase 5K and I hereby elect to voluntarily participate in said activity with full knowledge that said activity may be hazardous to me and my property. I voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death, that may be sustained by me or any loss or damage to property owned by me, as a result of being engaged in such activity, whether caused by the negligence of Vendor/Releaser or otherwise.
I hereby RELEASE, WAIVE, DISCHARGE, and HOLD HARMLESS Keep Soddy-Daisy Beautiful, The City of Soddy-Daisy, The Photographic Society of Chattanooga, its agents, volunteers, or officers, servants, agents, employees and other Elected officials (“RELEASEES”) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, injury or death, that may be sustained by me, anyone accompanying me, or to any property belonging to me while participating in All Keep Soddy-Daisy Beautiful Events.
I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage or costs that may incur due to participation All Community Beautification and Improvement Projects DBA Keep Soddy-Daisy Beautiful activities and events.
I expressly intend that this Release and Hold Harmless Agreement shall bind the members of the my family and spouse (if any), as long as I am living , and my heirs, assignees and personal representative, in the event of my death, and shall be deemed as a RELEASE, WAIVER, AND DISCHARGE of the above named RELEASES. It is hereby further agreed to that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Tennessee
I understand that the RELEASEES will not be responsible for any medical costs associated with any injury.
I have read this Registration, Waiver of Liability, and understand its terms, and I voluntarily execute it with full knowledge of its significance.
